Living Memorial Terms

Version living-memorial-temporary-2026-10-09 · 9 October 2026

These terms add to the main Once Spoken Terms of Use. If these terms conflict on an Once Spoken Collection matter, these more specific terms apply. Your statutory rights are unaffected.

1. Temporary access

Living Memorials are currently available at no charge for verified owners of approved memorials. Temporary access includes 30 photographs, 10 audio recordings, 3 short videos, written material within reasonable technical limits, contributor invitations, owner moderation, visibility controls, guardian nomination and owner export.

2. Ongoing costs and future charges

Living Memorials are temporarily free to use. Ongoing storage, hosting and maintenance costs mean charges will be introduced later. We will explain prices before you choose whether to continue. No payment details are needed now and you will not be charged automatically. No fixed preservation period is promised during temporary access.

We will explain future prices and the effect on access before asking you to choose whether to continue. Accepting temporary access does not authorise a future payment or subscription. You may export your material before deciding. Keep your own copies of important material. Scheduled future-message delivery and purchases of preservation time are not part of this temporary offer.

3. Existing agreements and stopping access

This offer does not shorten or replace preservation terms already agreed through a paid purchase or an earlier promotion. Those agreements remain governed by their recorded order and previous paid and promotional terms. Statutory rights are unaffected.

You may stop using temporary access or request removal through the removal route or contact form. There is no temporary-access payment to refund.

4. Content and permissions

You retain rights in material you own. You confirm that you own the necessary rights or have permission to upload it and that publication will not unlawfully expose a living person.

You give Once Spoken a non-exclusive, royalty-free licence limited to storing, reviewing, securing, technically processing, displaying as authorised, delivering as scheduled, backing up, exporting and migrating the material to operate the Collection. It does not permit sale, advertising use, AI training, voice cloning, synthetic speech, impersonation or generating new words or media on behalf of the deceased.

5. Contributions and moderation

Contributor submissions are private and pending. The owner may approve or decline them. Nothing submitted by a third party becomes public automatically. Once Spoken may restrict or remove material for legal, privacy, copyright, safeguarding, authenticity or Terms reasons.

Contributor email addresses and guardian and future-recipient details are private and are not part of the public Collection.

If a Collection is full, an invited contributor's media may be held privately for up to 7 days while capacity is considered. It remains pending and cannot be published during that period. If capacity is not available by the stated deadline, the media is deleted. Ordinary incomplete upload reservations expire within 24 hours.

6. Guardians and succession

A guardian is a nominated recovery contact, not an automatic owner. Nomination or acceptance is not a will, probate decision, transfer of copyright or transfer of estate property. A later succession request is separately verified.

If control is disputed, we may freeze administrative transfer and destructive changes, preserve the Collection and request probate documents, a court order or documented agreement. We do not determine competing family or inheritance rights.

7. Future messages

Scheduled delivery is available only where supported by an existing agreed preservation term. Temporary access does not include a future delivery guarantee.

8. Export

The verified owner may request an export of Collection records and media using private, time-limited links. Export does not transfer copyright belonging to contributors or other rights holders.

9. Refunds and service failure

Duplicate or erroneous charges are refunded. Where the service is faulty or not as described, we will provide the remedies required by law, which may include repair, repeat performance, a price reduction or refund.

For visitor Add Time and contributor-funded capacity, the purchaser—not the Collection owner—is the customer for that purchase. Cancellation and refund requests are assessed against that purchaser's statutory rights. Applied time is not silently removed from the beneficiary Collection after a refund; capacity linked to declined or unlawful material is not a promise that the material will be published and may remain available for other lawful Collection material. Fraud, chargebacks and refunds are reconciled without granting the purchaser control over content.

If we plan to discontinue Collections before the end of a paid term, we will where reasonably possible provide notice and export and an appropriate remedy for the materially unprovided service. We do not exclude statutory consumer rights.

10. Safety reports, moderation appeals and complaints

Anyone may report illegal or harmful material, a privacy concern, impersonation, copyright infringement or appeal a moderation decision through the Collection safety route. Once Spoken uses proportionate systems to prevent users encountering illegal content, restricts credible harm promptly, swiftly removes illegal content when aware of it, and records moderation decisions. The Collection owner cannot prevent Once Spoken restricting or removing material. General service complaints may be made through the Once Spoken contact form. The contract is with Robert Hawes, a sole trader trading as Once Spoken. The operator’s geographical and service address is 201 Linley Drive, Hastings, East Sussex, TN34 2BX, United Kingdom. General contracting information is also provided in the main Terms and order confirmation.
